Terms of Service for Fluenc

Welcome to Fluenc, a platform for creating, sharing, and exploring stories. These Terms of Service ("Terms") govern your access to and use of the Fluenc website, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1. User Accounts and Eligibility

1.1. Account Creation

To access certain features of the Service, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account.

1.2. Eligibility

You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that you are at least 13 years of age. We do not knowingly collect or store personal information from anyone under the age of 13.

2.1. Ownership of Content

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). You are responsible for the User Content you post, including its legality, reliability, and appropriateness.

2.2. License to Fluenc

By submitting User Content, you grant Fluenc a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and Fluenc's business, including for promoting and redistributing part or all of the Service.

2.3. User Content Restrictions

You agree not to post any User Content that is:

• Unlawful, harmful, threatening, abusive, or harassing.
• Defamatory, libelous, or invasive of another's privacy.
• Infringing on any intellectual property rights of others.
• Obscene, sexually explicit, or pornographic.
• Promoting illegal activities or containing hate speech.

3. Payouts and Revenue Sharing

3.1. Revenue Sharing

Fluenc may offer a revenue-sharing program for creators and referrers based on the terms and conditions outlined in a separate agreement or on the platform. Eligibility for and calculation of payouts are at our sole discretion.

3.2. Payment Processing

All payouts will be processed through our designated third-party payment processor, Stripe. You must have a valid Stripe account to receive payouts. Fluenc is not responsible for any delays, errors, or issues with payment processing caused by Stripe.

4. Intellectual Property

All content on the Service, except for User Content, including but not limited to text, graphics, logos, images, and software, is the property of Fluenc and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute this content without our express written permission.

5. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Fluenc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Your use of these third-party services is at your own risk.

6. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

7. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Fluenc makes no warranties, whether express or implied, regarding the Service's operation, availability, or the accuracy of its content. We do not guarantee that the Service will be uninterrupted, secure, or free from errors or viruses.

8. Limitation of Liability

In no event shall Fluenc, its affiliates, or its employees be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the courts of British Columbia to resolve any dispute arising out of these Terms.

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
